GENERAL PROVISIONS
The online store available at www.truefungi.shop is operated by LEAFY Sp. z o.o., with its registered office at ul. Borkowska 5A/15, 30-438 Kraków, Poland, VAT ID: 6793242355, REGON: 52241495000000, email: info@truefungi.com.
These Terms and Conditions define the rights and obligations of Customers and the Seller.
The Terms are drawn up in Polish and constitute a contractual template within the meaning of the Civil Code.
Prior to placing an order, the Customer has the right to negotiate the terms of the contract with the Seller. If the Customer waives this right, these Terms and Conditions constitute the binding content of the contract.
The Terms are available at www.truefungi.shop under the "Terms" tab.
Unless otherwise specified, all products offered in the Store are new, free from physical and legal defects, and have been legally introduced to the Polish market. The Seller undertakes to deliver goods free from defects.
The Customer bears the cost of communication with the Seller in accordance with their service provider's tariff. The Seller does not charge additional communication fees.
Consumers have access to out-of-court dispute resolution, including through the permanent consumer arbitration court, mediation, the Provincial Inspector of Trade Inspection, the Consumer Federation, or the ODR platform: http://ec.europa.eu/consumers/odr
DEFINITIONS
- Store: the online store available at www.truefungi.shop
- Seller: LEAFY Sp. z o.o., ul. Borkowska 5A/15, 30-438 Kraków, Poland
- Customer: a natural person, legal entity, or organizational unit purchasing products from the Store
- Consumer: a natural person purchasing products not directly related to their business or professional activity
- Entrepreneur: a person or entity acting in the course of business activity
- Customer Account: the user account created upon registration and login
- Terms and Conditions: this document
CUSTOMER ACCOUNT
Creating a Customer Account requires completing the registration form.
The login is the user's email address. The password may include letters, numbers, and special characters.
Registration is free and voluntary, and is not required to place an order.
The Customer must provide accurate and truthful information.
ORDERS
The products presented in the Store are invitations to submit purchase offers and do not constitute binding offers.
Placing an order constitutes an offer to purchase.
Orders may be placed via a Customer Account or through the guest checkout option.
To place an order, the Customer must add products to the shopping cart, choose a delivery and payment method, and click the "Buy and Pay" button.
Placing an order requires acceptance of these Terms and Conditions.
After submitting an order, the Customer receives a confirmation email. The contract is concluded upon receipt of this confirmation.
PRICES AND PAYMENT
Available payment methods:
- Online payment
- Bank transfer: ING Bank, account number: 57 1050 1445 1000 0090 3279 6741. The Customer must include their name or company name and order number in the transfer reference.
- Cash on collection (by prior arrangement)
Prices include VAT and are stated in Polish zloty. Delivery costs are calculated separately and displayed at checkout.
The Seller expects payment within 7 days of order placement. After this time, the order may be canceled.
DELIVERY
Deliveries are made via courier services or parcel lockers, as selected by the Customer during checkout.
Shipping costs depend on the delivery method, carrier, and the total weight of the products ordered. The final delivery cost is presented before the order is confirmed.
Fresh mushrooms are shipped Monday to Wednesday until 10:00 AM. Other products are shipped Monday through Friday.
Shipments are processed only on business days, excluding public holidays.
Upon delivery, all benefits and risks related to the product are transferred to the Customer.
RIGHT OF WITHDRAWAL
Consumers may withdraw from the contract within 14 days without providing a reason.
Returns must be sent to the Seller's registered address.
Returned products must be complete, unused, unconsumed, and in their original condition. Items that are partially or fully consumed, or show usage beyond what is necessary to assess their nature, features, and functioning, may result in a reduced refund or refusal.
Return shipping costs are borne by the Customer. Refunds are processed within 14 days of receiving the withdrawal notice. The Seller may withhold the refund until the goods are received.
In accordance with Article 38 of the Consumer Rights Act, the right of withdrawal does not apply to fresh and perishable products (e.g., fresh mushrooms).
COMPLAINTS
Consumers may submit complaints within 48 hours of receiving the shipment by email to: info@truefungi.com. Complaints must include a description of the issue and product photos.
Complaints will not be accepted for:
- Fresh mushrooms with minor deformations due to transport
- Products missing original packaging or not in original condition
- Goods damaged by the Customer (e.g., improper storage)
- Products that have been consumed in whole or in part
It is recommended to inspect the package in the presence of the courier and prepare a damage report. Failure to do so may result in the complaint being rejected.
If packaging or goods are damaged upon receipt, the Customer must prepare a damage report with the courier. This document is essential for claiming damages. Without it, refund and complaint claims may be rejected.
The Seller will respond to complaints within 14 days.
WARRANTY
Entrepreneurs are not entitled to warranty rights for sold goods. Consumers retain warranty rights under the Civil Code.
PERSONAL DATA
The administrator of Customer personal data is LEAFY Sp. z o.o. For details, refer to the Privacy Policy at www.truefungi.shop.
ELECTRONIC SERVICES
The Seller provides the following electronic services:
- Customer Account registration
- Order processing
- Contact form
- Newsletter
Technical requirements include: internet access, an active email account, and an up-to-date web browser.
The Customer may terminate the electronic services agreement at any time by contacting the Seller via email.
FINAL PROVISIONS
The Terms and Conditions are available on the Store’s website and may be downloaded or printed.
The Seller may amend the Terms and Conditions. Any changes become effective 14 days after publication. Orders placed before changes take effect will be fulfilled under the previous terms.
These Terms are governed by Polish law. Disputes with Consumers are resolved by courts pursuant to the Code of Civil Procedure. Disputes with Entrepreneurs are subject to the court competent for the Seller’s registered office.
